PDS loses $390m case as London tribunal backs ECG in landmark ruling

Power Distribution Services Ghana Limited (PDS) has lost its $390 million compensation claim against the Electricity Company of Ghana (ECG) after an international arbitration tribunal in London ruled in ECG’s favor.
The decision, delivered after nearly three years of legal proceedings, ends one of Ghana’s most contentious energy disputes over the termination of the PDS concession agreement.
The tribunal dismissed all claims advanced by PDS, siding completely with ECG’s position.
According to the ruling, the tribunal found that fraudulent guarantees presented by PDS undermined the integrity of the concession, thereby justifying the government’s decision to terminate the agreement in 2019.
“This ruling is a victory not just for ECG, but for Ghana as a whole,” said a senior government source familiar with the proceedings. “It validates the country’s stance that public resources must be protected from fraudulent arrangements.”
The outcome shields Ghana from potential financial liabilities estimated at hundreds of millions of dollars.
It also restores clarity and confidence in the management of the country’s electricity distribution sector, which had been clouded by the dispute since 2019.
The PDS concession, signed in July 2018, was initially hailed as a major reform intended to inject private investment into Ghana’s power distribution network.
However, the deal collapsed a year later when the government discovered that PDS had failed to provide a valid payment guarantee, sparking a legal standoff both locally and internationally.
An Accra High Court had already dismissed a related lawsuit by PDS in 2021, further weakening its claims.
The London arbitration ruling now affirms ECG’s legal and contractual position.
PDS says it will take a decision on the way ahead after it has consulted with its lawyers.
