Supreme Court halts Kpandai parliamentary rerun

The Supreme Court has directed the Electoral Commission (EC) to suspend all proceedings and activities leading to the conduct of a parliamentary rerun in the Kpandai constituency, pending the final determination of a case before the court.
The directive places all preparations for the rerun on hold until the legal issues surrounding the matter are fully resolved.
When the case was called on Tuesday, the apex court adjourned proceedings to January 13, 2026, to allow for further consideration of the issues raised by the parties. Until a final ruling is delivered, the EC is barred from taking any steps towards organising or conducting the rerun election in the constituency.
The Kpandai parliamentary rerun has become the subject of legal contestation following disputes arising from the December 7, 2024, parliamentary election.
The application before the Supreme Court was filed by the New Patriotic Party (NPP) Member of Parliament for Kpandai, Mathew Nyindam, who is seeking to overturn a ruling by the Tamale High Court that nullified his election victory.
The Tamale High Court had earlier upheld an election petition filed by the National Democratic Congress (NDC) parliamentary candidate, Daniel Nsala Wakpal, and subsequently annulled the parliamentary election in the constituency.
In his application for judicial review, Mr. Nyindam argues that the High Court acted outside its jurisdiction in entertaining the petition and that the processes leading to the annulment were flawed. He is asking the apex court to quash the High Court’s judgment and all related proceedings arising from the election petition.
Following the High Court’s decision, the NPP filed an application for a stay of execution to prevent the EC from acting on the ruling while the matter is pending before the Supreme Court.
